End User License Agreement

This End User License Agreement (“EULA”) is a contract between you and Heijvis BV (Chopinstraat 15, 3752 HR Bunschoten, the Netherlands, Chamber of Commerce 89961439), the company behind PanelSay. It covers the PanelSay mobile application. It sits alongside our Terms of Service and Privacy Policy; where this EULA and the Terms of Service conflict, this EULA governs your use of the app.

By downloading, installing or using PanelSay you agree to this EULA. If you do not agree, do not use the app.

1. Who may use PanelSay

PanelSay is for people aged 13 and over. You give your date of birth when you create an account, and it decides what you can do here. Under 16: text questions and choices only — no photos, nothing shared publicly, and no questions about how someone looks. From 16: photos are allowed, and your results stay private. From 18: everything, including public sharing. If we learn an account belongs to someone under 13, we close it.

2. Your licence

We grant you a personal, non-transferable, non-exclusive licence to use PanelSay on any Apple-branded device that you own or control, as permitted by the App Store Usage Rules, or on any Android device you own or control. This licence is for your own use. You may not sell, rent, sublicense, redistribute, reverse engineer, decompile or attempt to extract the source code of the app, except where that restriction is prohibited by law.

3. What PanelSay is

PanelSay is entertainment. The panellists are fictional characters generated by artificial intelligence. They are not real people, they are not experts, and nothing they say is advice — not medical, legal, financial, psychological, dating, career or any other kind of advice. Their reactions are automatically generated text and can be wrong, contradictory or unkind by design. Do not make decisions that matter on the strength of a PanelSay verdict.

4. Zero tolerance for objectionable content and abusive users

There is no tolerance for objectionable content or abusive behaviour in PanelSay. You agree not to submit, upload or share:

  • photographs of any other person without that person’s clear consent;
  • any image of a person under 18;
  • sexually explicit material, nudity, or content that sexualises anyone;
  • content that harasses, threatens, defames, degrades or humiliates an identifiable person;
  • material that promotes hatred or violence against people or groups on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, age or sexual orientation;
  • content that encourages self-harm, suicide, eating disorders or other dangerous behaviour;
  • material that infringes anyone’s copyright, trademark, privacy or other rights;
  • anything unlawful under Dutch or European Union law;
  • photographs of an identifiable person submitted so the panel can rate or rank their appearance, unless that person is you or has agreed to it.

You also agree not to use PanelSay to impersonate anyone, to circumvent our content filters, or to automate access to the service.

5. Reporting, removal and blocking

Every publicly shared result and every panellist reaction carries a Report control. Reports go to a human. We review reports and act on them, normally within 24 hours.

We may remove any content, hide any shared result, suspend an account or permanently block a user from the service if we believe this EULA has been broken — without notice and without refund. Content that is reported repeatedly is hidden from public view immediately, before review.

If you believe content on PanelSay breaks these rules, use the Report control or email support@panelsay.com. We will tell you what we decided.

6. AI-generated content

Everything the panel produces is generated by artificial intelligence systems operated on our behalf by third-party model providers. Output is labelled as AI-generated inside the app and on every shared result. You may not present PanelSay output as the statement of a real person.

7. Your content

You keep every right you already have in what you upload. You give us the permission we need to process it in order to run the service — nothing wider. If you choose to make a result public, you also give us permission to display that result and the image attached to it on a shareable page. You can undo that: delete the result, or delete your account from the account screen.

8. Subscriptions

PanelSay is free to use with a daily limit. PanelSay+ is a paid subscription that renews automatically until you cancel. When you buy through the App Store or Google Play, the store handles payment, renewal, and cancellation, under its own terms; manage or cancel the subscription in your store account settings. Deleting the app does not cancel a subscription.

9. Support and maintenance

Heijvis BV is solely responsible for PanelSay and for any support it needs. Apple and Google have no obligation to provide any maintenance or support for the app. Support: support@panelsay.com.

10. Warranty and liability

PanelSay is provided “as is” and “as available”. To the extent permitted by law we make no warranty that it will be uninterrupted, accurate, or fit for any particular purpose. Nothing in this EULA limits any right you have as a consumer under Dutch law that cannot be limited by contract.

If the app fails to conform to any applicable warranty and you bought it through the App Store, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Any other claim, loss, liability, damage, cost or expense attributable to a failure to conform to a warranty is our responsibility, not Apple’s.

Our total liability to you is limited to the amount you paid us in the twelve months before the event that caused the claim.

11. Claims by third parties

Heijvis BV, not Apple or Google, is responsible for addressing any claim by you or a third party relating to PanelSay, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, claims under consumer protection or privacy law, and any claim that the app infringes a third party’s intellectual property rights.

12. Legal compliance

You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.

13. Third-party beneficiary

Apple and its subsidiaries are third-party beneficiaries of this EULA. On your acceptance of this EULA, Apple has the right — and is deemed to have accepted the right — to enforce it against you as a third-party beneficiary.

14. Law and disputes

Dutch law applies. Disputes go to the competent court in the Netherlands. As a consumer you may also bring a dispute before the court of the country where you live.
